Privacy Policy

1. General

This privacy policy applies to the website and any mobile application made available by Heineken Česká republika, a.s. ("We" or "HEINEKEN") for customers in the Czech Republic at https://heinekenceskarepublika.cz (hereinafter the "website"). We may collect certain personal information through this website. Please read this Privacy Policy carefully, as it contains important information to help you understand how we handle personal data that you provide, or that we obtain through the website ("personal data"). HEINEKEN is the administrator of the personal data collected and processed.

We respect your privacy and undertake that your personal data will be stored and managed in accordance with our legal obligations under applicable data protection legislation.

2. What personal data do we collect and how do we use your personal data?

You can use most of our website without having to provide personal data. In order to use certain services and for some of the purposes of the website, you need to provide your personal data so that we can process your requests or send you newsletters or other information. However, in addition to the data we strictly require and that must be provided, we also collect certain additional data when you visit our website. The required information on the website marked with an asterisk is required. If you do not provide the required information, we will not be able to provide the requested service or product.

We have identified the personal data we collect, the purposes for which we use it and the period for which we will generally store your personal data:

  1. customer service: in order to answer your question, if you sent it via the website, to download products or other service emails, including your bookinf of a tour of the brewery, we will process your name, email address or telephone number (depending on how you contacted us) and the question or issue you brought to our attention. We register your requests, questions and our answers and other activities necessary or appropriate to resolve your request.

We retain all information for a period of 1 year after your question or complaint has been resolved, or since the investigation has been completed and, if necessary, for a longer period of time for the time necessary to protect our rights and obligations.

  1. sending information leaflets [and/or other marketing information]: if you have subscribed to an information leaflet, we will use the email address you provided to send you the information leaflet. You will be automatically added to our customer database. If you have ordered one of our products through our website, we may also send you information leaflets to inform you about other similar products that we think may be of interest to you. If you no longer wish to receive emails from us, you may unsubscribe at any time using the unsubscribe feature in each email, or contact us.

We use your personal data for the purpose of processing your subscription, or fulfilling an agreement or contract concluded with you, or if it is in our legitimate interest to send customers information about our products. We will remove the email address from our database after you have unsubscribed from the information leaflet, unless it is used and retained for other purposes set forth in this Privacy Policy.

  1. Marketing: Information about your purchases, your online searches (clicks and views), your web settings, your customer service requirements, and your contact history can be combined. This information allows us to use various channels to manage the relationships and market our products and services via email (information leaflet), which may include customizing the content and offers of the website to suit your preferences. If you have given us your consent, we may also send you information about the products and services of other HEINEKEN group companies. We also measure the effectiveness of our campaigns.

You can unsubscribe from our information leaflet or direct mail at any time, and you can also object to the use of your personal data for direct marketing purposes (for more information on how to do this, see the paragraphs below about your rights).

We use the above personal data in our legitimate interests to promote our products and services to our customers and website visitors, to reach more customers, to improve sales of our products and services, and to fund our website (through online advertising). We will retain personal data in the manner specified for the relevant purpose for which the personal data was collected (e.g. information leaflets). Personal data will be deleted or anonymised after this purpose expires, except in cases where we are obliged by law to retain personal data, or we have a different legal basis for their further storage. (For example, if you have granted your consent to receiving a newsletter, we process personal data for this purpose until its revocation). 

  1. we collect certain information when you visit our website, such as your [IP address, clicks and views]. We can also track how you use our leaflet, which pages you view and which sections you read, so we can tailor the leaflet to your preferences. Information about the use of our website and services allows us to create segments that represent groups of website visitors or customers with a number of common characteristics, such as age group, gender or region. You can also use the data to create segments that are used to customize the website, such as changing the order of search results or where we place certain offers so that you're more likely to see them. We may also use segments to show ads online that we think are relevant to you.

We use this personal data to the best of our ability to promote our products and services to our customers and website visitors, to reach more customers, to improve sales of our products and services, and to fund our website (through online advertising).

  1. Your personal data will also be used to maintain and analyze our website in order to resolve performance issues, improve accessibility and secure the website against fraud (e.g. in the case of repeated login attempts, or if a purchase is made in violation of our Terms and Conditions, e.g. purchase by persons under 18 years of age). We record the overall use of our website.

Our use of your personal data for these purposes is necessary for our legitimate interests and will be immediately deleted or anonymized upon expiry of the purpose of their use. 

  1. Allows participation in lotteries, competitions or other promotional events. Your personal data, such as: name, email address and/or telephone number, will be processed to organize and manage our lotteries, contests or other promotions that you choose to participate in. Some of these promotions include additional policies that include information about how we use and disclose your personal data. We use this data to manage our contractual relationship with you.[SM2] 

3. How we share your personal data

We may need to share your personal data with third parties to help us provide services and products and to operate our website. These third parties include:

  • HEINEKEN group companies for the purpose of retaining personal data processed via the website through shared information systems,
  • service providers where necessary to provide a service or to assist in providing or delivering a service or product that you have ordered on the website (including our third party supplier) and the provision of data analysis services,
  • an independent debt collection agency, lawyers, or other agents for the purpose of recovering amounts due or outstanding on the account,
  • in the event that HEINEKEN sells all or some assets or shares of a HEINEKEN group company whose personal data is transferred to a third party, your personal information may be provided to this third party.

These parties may be based in the Czech Republic, other countries of the European Economic Area, or elsewhere in the world. When retaining personal data outside the EEA, we will ensure an adequate level of protection for the transferred data. We require service providers to take appropriate measures to protect the confidentiality and security of personal data.

We may also need to make personal data available to law enforcement to comply with any legal obligations or court orders.

4. Bezpečnost osobních údajů

5. Uchovávání osobních údajů

Osobní údaje uchováváme tak dlouho, jak je požadováno zákonem, nebo tak dlouho, jak je nezbytné k poskytnutí jakýchkoli požadovaných služeb nebo nebo jak vyžadují jiné účely uvedené v těchto zásadách ochrany osobních údajů. Specifický termín uchovávání je uveden v těchto zásadách ochrany osobních údajů pro každý z příslušných účelů. Uděláme přiměřené kroky k zničení nebo anonymizaci osobních údajů, které vlastníme, pokud již nejsou potřebné pro výše uvedené účely nebo po uplynutí stanoveného období uchovávání.

6. Cookies

Velká část informací uvedených v těchto zásadách ochrany osobních údajů se shromažďuje prostřednictvím našeho používání souborů cookie a podobných postupů. Soubory cookies jsou malé textové soubory, které obsahují malé množství informací, které se stahují a mohou být uloženy na vašem uživatelském zařízení, například v počítači, smartphonu nebo tabletu. Postupy, které používáme, které mohou být podobné souborem cookie, jako např. trackovací pixely, javascrit, značky. You can choose to share information on our website via social media, such as Facebook, Instagram, LinkedIn, YouTube. This means that the information you share, with your name and preferences, will be visible to visitors to your personal site. We encourage you to read the social media privacy policies carefully, as these apply to the processing of your personal data by these parties.

8. Protection of children's data

The website is not intended for use by persons under the age of 18. We will not knowingly collect personal data from persons under the age of 18.

9. Your rights to access, correct, delete, restrict processing, and data portability

You have the right to request an overview of your personal data processed by or on behalf of our company. You have the right to correct, delete or restrict the use of the data (as required). You can exercise this right via the email address below. Please note that requests that do not meet the requirements of relevant legal regulations or HEINEKEN guidelines, or that are not accompanied by the required information upon request, will ultimately be rejected, and that certain personal data may be excluded from such requests for access, correction and deletion under applicable law on personal data protection or other laws and regulations. We store personal data when required by law. 

You have the right to obtain the personal data you have given us in a structured, commonly used and machine-readable format, and in certain circumstances we will transfer your data to another operator at your request, if technically possible.

10. Your right to object

You also have the right, in certain circumstances, to request that we stop processing your personal data, but if we have a legitimate legal basis, we will continue to process your personal data. However, you have the right to object to the use of your personal data for direct marketing purposes, including profiling, and if you do so, we will comply with your request. If you have given your consent to the use of your personal data, you have the right to withdraw your consent without affecting the legitimacy of our use of this data before your withdrawal of your consent. 

11. Update

We will review this Privacy Policy and update it from time to time. Any changes to this Privacy Policy will be posted on our website and, to the extent reasonably possible, we will notify you of them.
